Terms & Conditions
When you place an order with Meroda Cosmetics (“we”, “us” or “our”) for products sold on the Site (“Products”), you are considered to have read, understood and accepted these Terms and Conditions (“Terms and Conditions”).
Please go through these Terms and Conditions with care and, if there is any part of them you are not happy with, speak to one of our customer service advisors before you place an order with us.
These Terms and Conditions are amended by us from time to time. Check the top of this page to see the date on which they were last updated. Each time you order Products from us, the Terms and Conditions in force on the date of your order govern the contract between you and us. Should we have to revise them in a way that has a material impact on your order, we will get in touch to give you reasonable advance notice of the changes and to explain how you can cancel the contract if the changes do not suit you.
1. Introduction
These Terms and Conditions apply to the use of our website and to the purchase of the products offered through it.
The website is run by our company, which is registered in the Netherlands.
By browsing the website or placing an order, you accept that you are bound by these Terms and Conditions.
Your legal rights always come first. Nothing in these Terms, in our Returns & Refund Policy, in our Product Satisfaction Guarantee or in any Customer Support message restricts the mandatory rights you hold under applicable consumer law, including the rights that cover faulty, damaged, unsafe, incorrect, misdescribed or undelivered products.
These Terms apply together with the following policies:
Privacy Policy
Cookie Policy
Returns & Refund Policy
Those documents are an integral part of the agreement between the customer and us.
Should there be any inconsistency between these Terms and the Returns & Refund Policy, the Returns & Refund Policy prevails as far as returns and refunds are concerned, unless mandatory consumer law says otherwise.
2. Eligibility
By placing an order on this website, you confirm that:
you are at least 18 years old,
you are using the website with the permission of a parent or legal guardian.
You also agree not to use the website for unlawful purposes or in breach of applicable laws and regulations.
3. Products and Product Information
We sell cosmetic products and cosmetic tools meant for personal use.
We do our best to keep every product description, image and piece of information on the website accurate. Even so, details such as colour representation can differ depending on lighting conditions, device display settings and individual skin tone.
How a cosmetic product performs and looks can also differ from person to person, according to factors such as skin type, application technique and personal skincare routines.
We cannot guarantee identical results for all users.
4. Personal Use Only
Products bought from the website are meant for personal use only.
Reselling, redistributing or making commercial use of our products without our written permission is prohibited.
The same restriction covers promotional products, free gifts and items received through loyalty or promotional programmes.
5. Pricing
Every price shown on the website includes VAT unless it is stated otherwise.
Prices can change at any moment without prior notice.
Where there is a pricing error or an incorrect product listing, we reserve the right to cancel or refuse the order affected. If payment has already gone through, the customer receives a full refund.
6. Order Acceptance
Orders placed through the website are subject to our acceptance.
An order counts as accepted from the moment the customer receives an order confirmation email.
We reserve the right to refuse or cancel orders in situations that include, but are not limited to:
- suspected fraudulent activity
- payment verification issues
- product availability errors
- pricing errors
- suspected resale activity.
Where an order is cancelled after payment has been received, the payment is refunded to the original payment method.
7. Cancellations and Order Changes Before Fulfilment
We process orders quickly. If you ask for a cancellation or an address change before fulfilment, we will do our best to help.
Once an order has been fulfilled, packed or handed over to the warehouse / carrier process, cancelling or amending it may no longer be possible.
None of this affects the statutory cancellation, withdrawal, return or faulty-product rights that apply after delivery.
8. Delivery
The delivery times shown at checkout are estimates and can vary with the destination and with carrier conditions.
We are not responsible for delivery delays caused by:
- courier disruptions
- customs procedures
- weather conditions
- incorrect delivery details supplied by the customer. Customers are responsible for making sure their delivery address is correct.
For deliveries outside the EU, local import duties, taxes, customs fees or handling charges may be due. Those charges are set by local authorities or carriers and are the customer’s responsibility unless something different is stated at checkout. Refusing to pay the applicable charges can lead to the parcel being returned, delayed, abandoned or destroyed, depending on the carrier and on the customs process.
If a shipment goes back to sender because the address information was wrong, because the parcel was not collected or because applicable import duties were not paid, reshipping it may require payment of an additional shipping fee.
None of this affects the mandatory consumer rights that apply when an order is faulty, damaged, incorrect, not as described, or not delivered because of an issue for which we are legally responsible.
9. Right of Withdrawal for EU Consumers
If you are a consumer based in the European Union, you may withdraw from your purchase within 14 days of receiving the product, and you do not have to give a reason.
To use this right, you have to notify us within the withdrawal period.
Returned products have to be unused and sent back in their original packaging, together with any protective packaging, seals, labels, accessories and free gifts included with the order, where applicable.
Certain cosmetic products and beauty tools come with a hygiene or tamper-evident seal because they are personal-use items. Where local law allows it, these products may no longer be eligible for statutory cancellation / withdrawal or for a voluntary change-of-mind return once the hygiene seal has been broken after delivery.
None of this affects your rights if the product is faulty, damaged, unsafe, incorrect, or not as described.
10. Returns and Refunds
Returns and refunds follow our Returns & Refund Policy, which forms part of these Terms.
In general:
Unopened products may be eligible for return within the legal withdrawal period.
Opened cosmetic products and beauty tools may not be eligible for return where hygiene restrictions apply.
Refunds or other legally required remedies may be granted for faulty, damaged, unsafe, incorrect, misdescribed or otherwise non-conforming products.
Further detail on eligibility, procedures and timelines is set out in the Returns & Refund Policy.
Nothing in the Returns & Refund Policy restricts the mandatory rights you hold under applicable consumer law.
11. Product Satisfaction Guarantee
We may offer a Product Satisfaction Guarantee on selected products.
That guarantee is a voluntary commercial policy meant to support customer confidence, and it does not replace statutory consumer rights.
Eligibility for the guarantee may depend on conditions such as:
proof of purchase
time limits
limitations on repeated claims
provision of supporting information.
We reserve the right to refuse guarantee claims where misuse or abuse is suspected.
The full details of the Product Satisfaction Guarantee are given in the Returns & Refund Policy.
Nothing in the Product Satisfaction Guarantee restricts your rights if a product is faulty, damaged, unsafe, incorrect, not as described, or otherwise fails to meet applicable legal guarantees.
12. Defective, Damaged, or Incorrect Products
Where a product arrives faulty, damaged, unsafe, incorrect, not as described, or otherwise failing to meet applicable legal guarantees, the customer should let us know within a reasonable timeframe after delivery.
Customers may be asked to provide:
- photographs of the product
- photographs of the packaging
- the product batch number
- any other information reasonably needed to assess the issue.
Where a product is faulty, damaged, unsafe, incorrect, not as described, or otherwise fails to meet applicable legal guarantees, we provide the remedy required under applicable law.
Depending on the issue, that may be a refund, a replacement, a repair where relevant, a price reduction, compensation, or another remedy required by law.
Store credit may be offered as an option, but it does not replace a refund where the customer is legally entitled to one.
13. Limitation of Liability
To the maximum extent the law permits, we are not liable for indirect or consequential damages, including loss of profits, loss of business, or loss of data.
Nothing in these Terms excludes liability where excluding it would be unlawful, including liability for death or personal injury caused by negligence and liability arising from defective products under applicable consumer protection law.
Nothing in these Terms restricts mandatory consumer rights that cannot legally be limited or excluded.
14. Intellectual Property
All intellectual property rights relating to the website and to its content, including trademarks, logos, product images, text and graphics, remain our property or that of our licensors.
No content from the website may be copied, reproduced, distributed or used for commercial purposes without our prior written permission.
15. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time.
Where changes materially affect customer rights, customers are informed through appropriate communication channels.
Carrying on using the website after any change means the updated Terms are accepted.
16. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the Netherlands.
If you are a consumer living in another country within the European Union, the mandatory consumer protection laws of your country of residence may apply as well.
If you have a complaint, please contact our Customer Support team first so that we can try to sort the issue out directly. Where applicable law requires it, you may also turn to local consumer dispute resolution bodies, consumer authorities or other complaint routes in your country of residence.
